General terms and conditions of the company Folien-Design-Performance

1. Subject matter of the contract
The terms and conditions apply to all types of services provided by the company Folien-Design-Performance or its vicarious agents. Our general terms and conditions apply exclusively to the contract. In particular, other conditions do not become part of the contract if the company Folien-Design-Performance performs services without expressly contradicting other terms and conditions of the respective contractual partner. Other regulations, excluding the present General Terms and Conditions, only apply if the company Folien-Design-Performance has made contradicting agreements with its customers in individual contracts.

3. Prices
The prices of Foil-Design-Performance do not include the statutory value added tax, unless otherwise expressly agreed in writing beforehand. With the creation of a new price list, if one exists, all previously published price lists lose their validity. Transport costs for the vehicle to another location are only included in the final prices if this has been expressly agreed. Otherwise, the vehicle must be collected from our company after completion.

4. Down payment
When the order is placed in writing, the customer must pay a deposit of 50% of the final price within 7 days. After receipt of the down payment, the company Folien-Design-Performance orders the foil as requested by the customer. After ordering the film, if the customer withdraws from the contract, regardless of the legal reason, it is to be paid by the down payment made, so that the customer is not entitled to reimbursement of the down payment made after the film has been ordered, as the film is ordered individually according to the customer's request.

5. Preparation of the areas by the customer / extra work
The basis of a boat, furniture, full / partial vehicle wrapping is the provision of a thoroughly cleaned vehicle (boat / furniture). The application of polish / wax to the paintwork must be dispensed with before bonding. The paint must be completely free of wax before bonding.
Coarse and stubborn stains such as tar stains, insect residues, adhesive residues, etc. and, when laying sun protection films, in particular residues of old films, etc. must be removed by the customer before starting work. If we carry out this additional work, we charge a lump sum of € 30.00 / hour. plus VAT.
The customer assures that the vehicle is made available in a thoroughly cleaned condition for the work to be carried out. The customer further assures that a painting was not carried out within the period of 3 weeks before the start of the work of the firm Folien-Design-Performance. Attachments are to be removed by the customer. If these have not been removed, Folien-Design-Performance assumes no liability for these parts.

6. Design according to customer requirements / rights of third parties / copyright
If the customer wishes his film to be individually designed, he must provide us with the information and templates required for film printing immediately after the contract has been concluded. The buyer undertakes not to submit any templates that interfere with the rights of third parties (in particular copyright, naming rights and trademark rights) or that violate existing laws. The customer expressly releases us from all claims asserted against us by third parties in this context. The claim for indemnification also includes the costs of any legal defense that may be required by us. For advertising purposes, we regularly take photos of our work or of customer vehicles and publish them on our website. By concluding a contract, the customer agrees to this publication with regard to the wrapping service. To protect personal rights, labels are made unrecognizable. The rights to the pictures are exclusively with us and may not be copied or published without our consent.

7. Design drafts / practical implementation
Upon request, we can produce design drafts in advance on a two-dimensional vehicle line drawing. This serves as a rough illustration of the foiling / labeling. When this two-dimensional design is transferred to the vehicle, the vehicle shapes, which are three-dimensional, can lead to possible deviations in the positioning of the graphics / fonts, etc. We have no technical influence on this, so this is not a reason for complaint. The above also applies to two-dimensional design drafts submitted by customers.

8. Shelf life of the foiling / substrates
We expressly point out that the vehicle or boat must not be washed in any way for 6 days after the wrapping. The film is only suitable for washing machines after 4-6 weeks.
The durability of the film depends on the nature of the surface on which it is to be glued. The film usually lasts between 5 and 10 years on clean, wax- and polish-free surfaces. A guarantee for a certain minimum shelf life cannot be given, since the shelf life depends on the preparatory work of the customer. A shortened shelf life is also common with overpainted plastic parts. Unpainted plastic parts with silicone content cannot be glued. Paint corrections after accidents or other influences usually do not represent an obstacle during gluing, provided they were carried out by a specialist company.
